By accessing or using Shiftura ("the Service"), operated by Kids Go Out LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Shiftura is an employee scheduling platform that allows businesses to create schedules, manage shifts, track employee availability, and facilitate shift swaps. Our Service includes:

  • Schedule creation and management tools
  • Employee shift assignments and tracking
  • Shift swap marketplace
  • Availability management
  • Fairness metrics and analytics
  • Email notifications

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

Shiftura offers various subscription plans with different features and employee limits:

  • Free Plan: Up to 5 employees, all core features included
  • Team Plan: Up to 25 employees, $39/month or $390/year
  • Pro Plan: Up to 75 employees, $79/month or $790/year

By subscribing to a paid plan, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the end of the billing period. Refunds are provided at our discretion.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Impersonate any person or entity
  • Harvest or collect user information without consent
  • Use the Service to send spam or unsolicited communications

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and sharing of information as described in the Privacy Policy.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Kids Go Out LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8. User Content

You retain ownership of any content you submit to the Service (schedules, employee data, etc.). By submitting content, you grant us a license to use, store, and process that content solely for the purpose of providing the Service to you.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDS GO OUT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
